When damage occurs to a third party due to a product with a manufacturing defect, legal liability is primarily a matter between the user, the injured party, and the manufacturer.

At Celtic WebMerchant, we adhere to the following guidelines:

  • Product Liability: The legal responsibility for consequential damage (damage to persons or other items) caused by a defective product lies with the manufacturer of the item.
  • Our Role: We are responsible for delivering a sound product to you. If there is a demonstrable manufacturing defect, we will resolve this through repair, replacement, or refund of the product itself.
  • Correct Use: The warranty and any liability of the manufacturer are voided when a product is misused or when you have made modifications without our consent.
  • Risk with Intensive Use: For products such as "battle-ready" swords or armor, it is important to know that damage due to the intensity of use (such as reenactment battles) is considered user damage and not a manufacturing defect. Weapons are often designed to inflict damage; the user is responsible for safe use in that context.

If an incident occurs where you suspect a manufacturing defect is the cause, you must report this to us immediately with clear photos, videos, and the exact context of the use. We can then assess the situation in consultation with the supplier or manufacturer.
